Division Overview
The Portfolio Management and Compliance Division ensures housing program compliance and financial compliance with federal and state regulatory mandates through established oversight and monitoring procedures. Onsite monitoring visits and desk reviews are mechanisms used for in-depth investigation and overall assessment, respectively.
Compliance objectives are achieved through two sections within the division: Contract Monitoring (including two subsections: Program Monitoring and Single Audit) and Compliance Monitoring.
Contract Monitoring
The Contract Monitoring section is responsible for ensuring that the Department’s HOME, HTF, CDBG Disaster Relief and CDBG Self Help Center programs are administered and funds are expended in accordance with contract provisions and applicable State and Federal rules, regulations, policies, and related statutes. The Contract Monitoring section is also responsible for ensuring that Department programs are in compliance with federal and state Single Audit requirements. Contract monitors review necessary program documents and financial records through desk reviews and on-site reviews to ascertain compliance with program requirements. Site inspections of assisted housing properties are also conducted to ensure that workmanship complies with federal, state, and industry standards and specifications.
Selection of contracts for monitoring is primarily based on risk assessment. Contracts may also be selected for monitoring based on other factors, such as prior findings, complaints, or special requests.

Compliance Monitoring
The Compliance Monitoring section is responsible for long-term compliance with the various housing programs administered by the Texas Department of Housing and Community Affairs. Compliance monitors review necessary records to assure adherence to program requirements and terms of the deed restrictions on multi-family affordable housing properties. Compliance monitors regularly conduct site inspections to verify that the income of tenants and rents charged for housing are at or below limits established by programs such as the Housing Tax Credit, HOME, Tax Exempt Bond, Housing Trust Fund, and Preservation programs. Monitors perform on-site and desk monitoring reviews and collect Annual Owner's Compliance Reports as required under Chapter 2306 of the Texas Government Code. Compliance Monitoring is also responsible for fair housing issues, property compliance training, public information requests, and processing LURA amendments.
Information regarding compliance status of specific TDHCA monitored affordable housing properties may be obtained by calling or writing the Compliance Monitoring section. All Open Records Information requests must be submitted in writing.

Physical Inspections
The Physical Inspection section performs and administers inspections for developments monitored by the Portfolio Management and Compliance Division starting with plan reviews and continuing throughout the compliance period. Inspectors conduct site inspections, construction inspections, Uniform Physical Condition Standards inspections, and Texas Minimum Construction Standards inspections on new construction and acquisition and/or rehabilitation multifamily developments and for rebuilding or rehabilitation of single family homes. The section also administers inspections performed by the Department’s outside inspection contractors and for construction inspections and site reviews performed by staff from the Manufactured Housing Division acting for the Inspection Section.
